General Terms and Conditions

Summary

  1. raise is a charity fundraising platform where all the deposits into the platform ultimately go to charity. We do not offer refunds or withdrawals within the system. Refunds may be given if deemed that the deposit was made illegitimately or from a malfunction or bug of the platform.
  2. raise is a charity fundraising platform you cannot withdraw monies from the platform or play games for monetary gain. raise not a gambling service and is not licensed or regulated by the gambling commission.
  3. To use our services, you must register and open an account with us. By registering an account with raise, you will enter into a legally binding agreement with us which incorporates the General Terms and Conditions, our Privacy Policy and the Terms for the products and services that we offer and any applicable third-party terms and conditions in respect of the use of their software or services.   1. General

    1. By registering an account with raise (raise.io or associated applications) (see Registering and opening an Account)), you will enter into a legally binding agreement with us which is comprised of and includes:

      • these general terms and conditions
      • the specific rules for each of the products and services that we offer ("Game Rules") see Game Rules
      • any applicable third party terms and conditions in respect of the use of their software which are described in ("Third Party Terms").
    2. raise is a charity fundraising platform where all the deposits into the platform go to charity. You cannot withdraw monies from the platform or play games for monetary gain. raise is not a gambling service and is not licensed or regulated by the gambling commission.

    1. References in the Terms and Conditions to "us" "our" or "we" are references to Avastec Limited trading as raise. Avastec Limited is a company registered in England (08343634) and head office is located at Berkeley House, 6 The Square, Kenilworth, Warwickshire, CV8 1EB
    2. References to "you" and "your" in the Terms and Conditions are to you as the end user of the Services.
  3. Changes to Terms and Conditions

    1. We reserve the right to modify these Terms and Conditions from time to time (including to comply with applicable law or a change in our regulatory requirements). If we modify these Terms and Conditions, we will notify you of such modifications by providing a prompt with a link to the revised terms on our websites. Your continued use of the Services following such notification will be deemed binding acceptance of the changes. If any change is unacceptable to you, you should stop using our Services. It is your responsibility to review the Terms and Conditions and any amendments to them each time you use the services.
  4. Registering and opening an Account

    1. To use our services, you need to register and open an account with us ("Account"). You can open an account by clicking the "Join/Register" link on our websites or mobile and tablet applications. There are no set-up charges for opening an account with us.
    2. When you open your account, you will be asked to provide personal information, including (but not limited to) your name and email address. It is important that your email address is kept up to date so we can notify you of any changes to these Terms and Conditions. For further information about our collection and use of your personal information, please refer to our Privacy Policy.
    3. We reserve the right to refuse registration for any reason, including failure to meet our requirements.
  5. Information we collect about you and how it is used

    1. We process information about you in accordance with our Privacy Policy. Our Privacy Policy contains details on the types of information we collect and what we do with that information, which includes who it may be shared with and why.
  6. Eligibility

    1. You must be (18) eighteen years of age or older to use the services. By registering with us, you confirm that you are aged (18) eighteen years of age or older.
    2. Access to certain services may be prohibited to residents of, or persons located in, certain countries. We currently only accept users based in the United Kingdom.
  7. Login Credentials

    1. When you register with us, you will enter an email address and password for your account (unless you opt to use a social 3rd party login). You can change your email and password from within the app.
    2. You may not in any circumstances nominate or allow any person to be an authorised user of your account. It is your responsibility to ensure that you do not reveal your login credentials to anyone else. We shall not be liable for any claims if you disclose your login credentials or auth tokens to anyone else or where your negligence or deliberate act has contributed to such third-party access to your account. If you feel that your credentials have been compromised, change your password immediately.
  8. Use of Services

    1. We reserve the right to suspend, modify, remove, or add a product to our services at our discretion wherever possible.
    2. You must not misuse the services by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to: our websites; the servers on which our websites are stored; or any server computer or database connected to our websites or mobile and tablet applications. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them.
    3. You agree that you will not use the services in any way that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity, or cause distress, harm, or inconvenience to any other person.
    4. You agree that you will not use the services in any way other than for your personal use and for your own benefit.
    5. You agree not to give any indication that you have any commercial relationship with us or that you are our agent.
    6. The information which we or third parties provide (including results, statistics, fixture lists) on our websites and services is for your personal use only and the distribution or commercial exploitation of such information by you is strictly prohibited. We do not give any commitment or warranty in relation to the uninterrupted provision of such information, its accuracy or the results obtained through its use. No information which we or third parties provide on our websites and Services is intended to amount to advice or recommendations and is provided for information purposes only.
    7. We do not guarantee which products will be available on our services. The services are provided on an 'as is' and 'as available' basis. Whilst we use reasonable efforts to ensure that our services run smoothly, we cannot promise that the Services will be free from errors or omissions nor that they will be available uninterrupted and/or in a fully operating condition.
    8. In order for you to use our services, it may be necessary to provide you with software provided by a third party. The provider of such software may require you to agree to additional terms and conditions governing the use of their products. If you do not accept those third-party terms and conditions, do not use the relevant third-party software. You shall not interfere with, modify, or reverse engineer any software provided to you by us or any third party. We do not accept any liability in respect of any third-party software.
  9. Prohibited Activities

    1. You are strictly prohibited from using the services for any unlawful, illegal, immoral, or illegitimate purpose.
    2. The following activities are prohibited:

      1. any form of fraudulent or illegal activity, cheating, exploiting loopholes or bugs.
      2. modify or adapt the mobile applications or hack, merge, translate, create derivatives from the same, mimic, disable the same or otherwise tamper with them; this includes intercepting and modifying communications between the apps and the server.
      3. reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software, code or other intellectual property used to provide the mobile applications.
      4. if you are located in any territory or country in which the accidental or deliberate access or use of the Services is not supported including if you are using a VPN to disguise your location or to bypass any measures we may use to prevent or restrict access to the Services.
      5. if we have received a “charge back” and/or a "return" notification via a deposit mechanism used on your Account.
      6. if you use the Services other than for your personal and recreational use.
      7. if you engage in any abuse and/or harassment of our staff; or create a name that can be deemed offensive to others, including but not limited to swear words, religious words, racism words, rude or words that could incite violence or hatred.
      8. to try and mimic other user accounts and the official raise account.
      9. do anything (or attempt to do anything) which might disrupt use of the Services by us or other users, or which could threaten, harass, or upset other users of the Services or user community.
      10. Your use of the services is entirely at your own risk. We do not recommend using the Services if you have a history of, or propensity towards gambling or charitable giving addiction. Where you do use the Services, you warrant that you will do so responsibly, legally and prudently. If you are in any doubt as to your ability to do so, you should seek professional advice before using the Services.
  10. Game Rules

    The term “game” is used throughout these terms to encompass all games, challenges and prize draw activities that are supported by our services

    1. Challenges:

      1. When challenging friends, there must be a unanimous winner
      2. The charity nominated by the winner of a challenge will receive the losers’ stake as a donation (with transaction costs deducted)
      3. The winner’s stake will be returned to their account balance
      4. If the outcome of the challenge cannot be agreed on by all parties involved, then the stakes are returned back to each of the participants’ account balance.
    2. Prize Draws:

      1. No purchase, payment or donation of any kind is necessary to enter the prize draw and win a prize. A purchase, payment or donation in relation to an entry will not increase your chances of winning.
      2. Unless specified, there will be only 1 (one) winner of a prize draw
      3. You must be over the age of 18 (eighteen) and a full legal resident of the United Kingdom to enter
      4. For postal entries, they must arrive before closing date and time of the draw. Any late postal entries will not be entered, and you will not be notified of this. The address for postal entries is: Raise, PO Box 7100, Coventry, CV6 9SP
      5. All postal entries must be received by post (hand delivered entries are not eligible and will be void) before the applicable closing date and time to be valid.
      6. There is no limit to the number of entries or prize draws you can enter but we do advise you to adhere to responsible giving guidance. Only give what you can afford.
      7. The winner must have a valid email address and provide proof of account ownership before the prize is awarded.
      8. The winner must agree to their name, general location and photo shown in the app, website or social channels as a winner announcement.
      9. If the prize is supplied by a charity, then all donation entries will go directly to that charity (with transaction fees subtracted). If raise has provided the prize, then we reserve the right to recoup the value of the prize before any donations are transferred.
  11. Financial Transactions

    1. You can make financial deposits into your account by Apple Pay or Google Pay. Deposits should be made from a card in the name of the Account holder only.
    2. Deposits should only be made by an individual and not a company.
    3. Any transaction fees that may apply will be deducted from the amount when transferring to the chosen charity.
  12. Withdrawals and Refunds

    1. raise is a charity fundraising platform where all the deposits into the platform ultimately go to charity. We do not offer refunds or withdrawals within the system. Refunds may be given if deemed that the deposit was made illegitimately or from a malfunction or bug of the platform.
    2. You are not permitted to withdraw funds or winnings from your Account balance. All monies deposited can only be donated to charities, be used to enter prize draws or play games/challenges.
  13. Prohibited Activity, Fraud and Cheating

    1. We have zero tolerance for any fraudulent activity or cheating. The following actions are considered to fall under these categories:

      1. payment fraud
      2. using stolen or fraudulent payment details
      3. collusion with other users or individuals
      4. utilisation of software or AI to gain an unfair advantage
      5. exploitation of software bugs and malfunctions
      6. harass or offend staff or users of the platform
      7. if you allow (whether intentionally or unintentionally) someone else to use your Account
      8. issue a “charge back” and/or a "return" notification via your payment provider
      9. in breach of these terms
      10. trying to impersonate another user, charity or raise accounts
      11. an offensive or misleading display name
  14. Closure/Suspension of Account

    1. If you have breached these terms or engaged in prohibited activity as described in 14, then we have the right to suspend or close your account.
    2. Suspension of an account may occur if an investigation is required. The account will no longer be active, and the balance will be kept. Depending on the outcome of the investigation, the account may be reinstated or closed.
    3. If your account is closed, then your active balance will be given to a charity of our choice, all badges and history of the account will be erased. The account will be deleted from our platform.
  15. Delete/Close Your Account

    1. You have the right to close your account at any time. You can do this within the My Account > Settings section of the mobile app.
    2. Accounts that have been deleted are not recoverable and all information is permanently deleted.
  16. Dormant Accounts

    1. We will deem an account to be “dormant” after a period of 24 months of inactivity.
    2. We will contact you prior to your account being deemed dormant, and you may reactivate a dormant account at any time by logging into that account via the raise mobile app.
    3. If you account remains dormant at the end of the period of inactivity described in 17.1 then your account will be deleted in accordance to the deletion process described in 15.3.
  17. Limitations and Exclusions

    1. Nothing in these Terms and Conditions is intended to:

      1. fraud or for death or personal injury resulting from our negligence;
      2. breach of Your statutory rights as a consumer, or
      3. for any other liability which we may not limit or exclude under applicable law.

      For more information about Your statutory rights, you can contact your local consumer protection organisation e.g. the Citizens Advice Bureau.

    2. Subject always to Clause 17.1 above, we will not be liable for any damage or loss suffered or incurred by you as a result of:

      1. any use by you of our services in breach of these Terms and Conditions (including any Prohibited Activity on your part);
      2. failures caused by the equipment You use to access our websites, call centre or mobile and tablet applications or failures in any network;
      3. any incomplete, lost or delayed transactions (including as a result of technical failure);
      4. damage to your equipment (e.g. desktop, laptop, mobile, smartphone, tablet, games console or other internet-enabled device) or for any loss or corruption of data that results from your use of our websites or mobile applications (and we cannot and do not guarantee that any files that you download are free from viruses, contamination or destructive features) except that if any defective digital content that we have supplied to you damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation;
      5. the accuracy, completeness or currency of any information services provided by us or third parties (including but not limited to prices, times or results);
      6. any loss whatsoever arising from your abuse or misuse of your account or our services;
      7. any failure on our part to interact with you where we may have concerns about your activities;
      8. our closure or suspension of your account in accordance with these Terms and Conditions;
    3. You agree to compensate us for any costs, charges or losses sustained or incurred by us (including any direct, indirect or consequential losses, any loss of profit and any loss of reputation) arising directly from your fraud, dishonesty, criminal act or breach of these Terms and Conditions.
  18. Third Party Terms

    1. We use Stripe (stripe.com) for our payment processing, and any payments processed through the app are subject to their terms
    2. Stripe charge a transaction fee which can vary, please visit their website for their current fees.
